When your insurance company acts in bad faith

You’ve paid your insurance premiums every month.  A severe storms rolls through.  Large, gusty winds, lots of rain, hail.  The storm passes, and you realize you’ve got a leak coming from the roof.  You never had a leak before.  It must have been from the storm.  No worries, you think, this is why I have homeowner’s insurance.  An adjuster comes out and looks around.  Then, you receive a letter in the mail from your insurance company.  You think to yourself that this must be the check to repair your roof or instructions on how to move forward with fixing your roof.  You stomach sinks when you read the letter.  Your claim has been denied. 
 
What do you do next?  Is there anything you can do?
 
That sinking feeling of having a claim denied is felt more often that you’d think.  Our team has successfully handled several “bad faith” insurance cases.  What is a “bad faith” case?  This type of case is brought when an insurance company doesn’t uphold its end of the bargain.  Section 155 of the Illinois Insurance Code also allows for what is called extra-contractual remedies.  This means you can recover attorney’s fees and up to $60,000 on top of what is owed to you, i.e. the cost to replace your roof. 
 
Insurance companies have hundreds, if not thousands, of people working for it.  Don’t go it alone.  Know your rights.

Workers' compensation, pre-existing conditions, and degenerative disc disease . . . oh my!

Wendler and Zinzilieta, P.C., recently obtained a six-figure workers’ compensation settlement for a client who suffered from a herniated disc in their low back.
 
The client started their workers’ compensation claim without a lawyer.  The workers’ compensation insurer would not authorize or pay for any medical treatment for the client’s back pain because the insurance company believed the condition was pre-existing.  Insurance companies love to use the term “pre-existing” to avoid paying compensation for which you are rightfully owed.  “Pre-existing” is just a fancy way of saying you had problems with this area of your body before the injury you’re complaining of now.  In the context of a back or spine, you’ll often hear adjustors and defense/company doctors say that you have “degenerative disc disease” which predated the injury you currently have.  A majority of persons over the age of 25 have some “degenerative disc disease” in their backs and spines.  It simply means that your spine is aging.
 
In this case, the insurance company hired multiple “experts” and fought tooth and nail until the end.  We fought back and ultimately secured a win for our client.

When the other driver doesn't have insurance

Don’t be in the dark when it comes to uninsured motorist claims.  In Illinois, uninsured and underinsured motorist coverage is required by law.  This is something YOU pay for under YOUR insurance policy.  What does that mean?  If you’re involved in a crash and the other driver doesn’t have insurance, YOUR insurance company is supposed to kick in.  Again, this is coverage YOU have paid for.
 
This doesn’t mean that your insurance company will pony up your policy, however.  Your insurance company may only pay a small part of your policy or nothing at all.  This is not uncommon.  If you and your insurance company do not agree, then you’ll be forced into a mandatory arbitration.  The big insurance companies have a team on their side.  Don’t go it alone.  Let us be YOUR team.  Let us fight for YOU.  Your success is our goal.
